Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the Pilsmaatje application ("App"), available on iOS, Android, and the web, operated by Pilsmaatje ("we", "us", "our"), based in the Netherlands.

By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App. Please pay particular attention to section 9 (Drinking, drinking games and assumption of risk), section 14 (Limitation of liability), and section 15 (Indemnification).

2. About the App

Pilsmaatje is a social check-in app that lets you share what you are having — drinks, food, or anything else — with your friends. Features include a profile picture, check-ins with optional photo and location, reactions and comments, a friends system with username search and friend requests, a map view, achievement badges, real-time drinking games (e.g. Mexen and Bussen), event invitations for planning drinks with friends ("Borrels"), push notifications, and invite/QR flows.

Pilsmaatje is a personal project and is provided free of charge. There are no in-app purchases, subscriptions, or advertisements.

Pilsmaatje includes social drinking games. These are a light-hearted way to play with friends and are intended for adults of legal drinking age. Pilsmaatje does not encourage excessive or irresponsible alcohol consumption — always drink responsibly and within the law, and only if you choose to. You play these games entirely at your own discretion and risk. Important rules about alcohol, age, and responsible use apply — please read section 9 carefully.

3. Eligibility

You must be at least 16 years old to create an account and use Pilsmaatje. By using the App, you represent that you meet this age requirement.

We do not verify age. If we become aware that a user is under 16, we will terminate their account and delete their data.

Holding an account does not entitle you to consume alcohol. You must be of the legal drinking age in your jurisdiction to drink alcohol while using the drinking games — see section 9.

4. Your account

4.1 Registration

To use Pilsmaatje, you must create an account with a valid email address, a password, a display name, and a unique @username. Usernames are 3–20 characters and must not impersonate others or be offensive; we may reclaim usernames that violate these Terms.

4.2 Account security

You are responsible for keeping your login credentials secure. You must not share your account with others. Notify us immediately at info@pilsmaatje.nl if you suspect unauthorised access.

4.3 Account deletion

You can delete your account at any time via Settings > Delete Account within the App. Deleting your account removes your profile, username, check-ins, friendships, friend requests, photos, your profile picture, the comments you posted, game history and stats, and associated data. This action is irreversible. See the step-by-step instructions.

5. Acceptable use

When using Pilsmaatje, you agree not to:

1. Violate any law or regulation, including Dutch and EU law.
2. Harass, threaten, or harm other users.
3. Upload illegal, offensive, or harmful content, including but not limited to hate speech, violence, sexually explicit material, or content that promotes illegal activity.
4. Impersonate another person or entity.
5. Create fake or misleading accounts or use the App to spam.
6. Attempt to access other users' accounts or data without authorisation.
7. Reverse-engineer, decompile, or disassemble the App or its underlying technology, except where permitted by applicable law.
8. Use automated systems (bots, scrapers, etc.) to access or interact with the App.
9. Interfere with or disrupt the App's infrastructure, security, or other users' experience.
10. Upload content you do not have the right to share, including copyrighted material belonging to others.
11. Pressure, coerce, dare, or encourage any person to drink alcohol, to drink against their will, to drink while under the legal drinking age, or to drink to excess — whether through the games or otherwise.

We reserve the right to suspend or terminate accounts that violate these rules, without prior notice.

6. Content you create

6.1 Your content

You retain ownership of the content you create in Pilsmaatje (check-in photos, your profile picture, comments, custom item labels, display name). By posting content, you grant us a limited, non-exclusive, royalty-free licence to store, display, and transmit that content solely for the purpose of operating the App (e.g. showing your check-in, profile picture, or comments to the people who can see them).

6.2 Content responsibility

You are solely responsible for the content you upload. We do not pre-screen content but may remove content that violates these Terms.

6.3 Content availability

A check-in's active (live) status expires approximately 1 hour after creation; the check-in itself remains stored until you delete it or delete your account. We do not guarantee permanent storage of any content.

7. Friendships and social features

• Friendships are mutual. Both parties can remove a friendship at any time.
• You can connect by sharing an invite link or QR code, or by searching another user's @username and sending a friend request. Invite links and QR codes expire after 7 days.
• By adding a friend, you consent to them seeing your check-ins (including item, photo, location, and display name — both active ones and your activity history), your profile picture, your reactions and comments, badges, and any games you play together.
• Your reactions and comments on a check-in — shown with your display name and profile picture — are visible to everyone who can see that check-in. This may include other friends of the check-in's owner, even if you are not friends with them, and from these lists you can send friend requests to, and receive them from, those users.
• Borrel (event) invitations can only be sent to your own friends. If you are invited to a borrel, the host and the other invitees — who may include people you are not friends with — can see your RSVP status, display name, profile picture, and username. The event's details and location are visible to its host and invitees only.
• Reactions, comments, game participation, borrel invitations, and friend requests must not be used to harass, pressure, or spam other users.

8. Push notifications

Pilsmaatje may send push notifications to inform you about friends' check-ins, reactions, comments, friend requests, game invites, and borrel invitations (including RSVP updates and reminders). You can disable notifications at any time through your device's or browser's settings.

9. Drinking, drinking games and assumption of risk

9.1 Entertainment only

Pilsmaatje is a social entertainment app. The drinking games (such as Mexen and Bussen) are digital party games meant for light-hearted fun between friends, and borrel invitations are a way to plan getting together. The App does not sell, supply, serve, or provide alcohol, does not measure your actual consumption, and is not affiliated with, sponsored by, or endorsed by any producer or seller of alcohol.

9.2 Legal drinking age

While the minimum age to hold an account is 16 (see section 3), you must be of the legal drinking age in your country or region (18 in the Netherlands) to consume alcohol while using the App. By playing the drinking games with alcohol, you confirm that you meet that age requirement.

9.3 Alcohol is never required

The games never require you to drink alcohol. You alone decide whether and what you drink, and you can play with water, soft drinks, or any non-alcoholic beverage. Any reference in the App to "drinking", "sips", or "slokken" is part of the game theme and in-game scoring only — it is not an instruction, encouragement, dare, or requirement to consume alcohol, nor a record of how much you actually drink.

9.4 Drink responsibly

If you choose to drink, you are solely responsible for doing so responsibly, in moderation, and in accordance with the law. In particular:

• Never drink and drive, operate machinery, or do anything that requires you to be sober.
• Do not drink if you are under the legal drinking age, pregnant or breastfeeding, taking medication that interacts with alcohol, dependent on alcohol, or otherwise medically advised not to.
• Know your limits, look after the people you are playing with, and stop when you have had enough.
• Nothing in the App is medical, health, or safety advice. If you are concerned about alcohol use, seek professional help.

9.5 Assumption of risk and release

You acknowledge that consuming alcohol carries inherent risks and that you take part in the games, and in any drinking, entirely voluntarily and at your own risk. To the maximum extent permitted by applicable law, you assume all such risk and you release and hold harmless Pilsmaatje from any injury, illness, accident, loss, damage, or harm to you or any third party arising out of or relating to alcohol consumption, intoxication, or participation in the games — including personal injury, property damage, and the acts or omissions of other players or third parties.

9.6 No liability for consumption

To the maximum extent permitted by applicable law, Pilsmaatje is not responsible or liable for how you or others choose to play the games, for any amount of alcohol consumed, or for any consequences of that consumption. The disclaimers, limitation of liability, and indemnification in sections 13, 14, and 15 apply in full to the games and to any drinking associated with them. Nothing in this section limits any liability that cannot be excluded under applicable law (such as liability for death or personal injury caused by our own negligence, or for fraud).

10. Intellectual property

10.1 Our rights

The App, its design, code, branding, name, logo, and all related intellectual property are owned by Pilsmaatje or used under licence. You may not copy, modify, distribute, or create derivative works from any part of the App without prior written permission.

10.2 Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us the right to use them without obligation or compensation.

11. Third-party services

The App uses third-party services including Google Firebase (authentication, database, storage, push messaging), Google Maps, Apple Push Notification service, and Expo. Your use of the App is also subject to these providers' terms:

12. End User Licence Agreement (EULA)

This section serves as the End User Licence Agreement for the Pilsmaatje app as distributed through the Apple App Store and Google Play Store.

12.1 Licence grant

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, in accordance with these Terms and the applicable app store's terms.

12.2 Licence restrictions

You may not:

• Sublicence, sell, resell, transfer, assign, or distribute the App.
• Modify or make derivative works based on the App.
• Reverse-engineer the App except as expressly permitted by applicable law.
• Use the App for any illegal or unauthorised purpose.

12.3 App Store terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and Pilsmaatje, not Apple. Apple is not responsible for the App or its content.
• The licence granted is limited to use on Apple-branded products you own or control, as permitted by the App Store Terms of Service.
• Pilsmaatje, not Apple, is responsible for the App, including maintenance, support, warranty (see section 13), and any claims related to the App (intellectual property, product liability, consumer protection).
• Apple has no obligation to provide support or maintenance for the App.
• In the event of any failure of the App to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims you or a third party may have relating to the App.
• Apple is a third-party beneficiary of these Terms and may enforce them against you.

If you downloaded the App from the Google Play Store, Google's Developer Distribution Agreement and Terms of Service apply in addition to these Terms.

13. Disclaimers and warranty

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The App will be available at all times, uninterrupted, or error-free.
• The App will meet your specific requirements.
• Any data (including check-ins and photos) will be retained or recoverable.
• The drinking games are suitable, safe, or appropriate for you or any other player; they are provided for entertainment only.

The App does not supervise, monitor, or control your or any other person's consumption of alcohol, and we take no responsibility for it. You are responsible for your own behaviour and well-being at all times.

14. Limitation of liability

To the maximum extent permitted by applicable law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.
• We shall not be liable for any injury, illness, death, property damage, or other loss arising from or related to alcohol consumption, intoxication, or participation in the drinking games, whether suffered by you or any third party.
• This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise).

These limitations do not affect your statutory rights as a consumer under Dutch or EU law, including rights under the Dutch Civil Code (Burgerlijk Wetboek) that cannot be waived, and nothing in these Terms excludes or limits our liability where it cannot lawfully be excluded or limited (for example, for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation).

15. Indemnification

You agree to indemnify and hold harmless Pilsmaatje from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your use of the App.
• Your violation of these Terms.
• Content you upload or share through the App.
• Your consumption of alcohol or your participation in the drinking games.
• Your violation of any applicable law or the rights of a third party.

16. Termination

16.1 By you

You may stop using the App at any time. You can delete your account via Settings.

16.2 By us

We may suspend or terminate your account at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the App ceases immediately.

16.3 Effect of termination

Upon termination, your data will be deleted in accordance with our Privacy Policy.

17. Changes to these Terms

We may update these Terms from time to time. When we make significant changes, we will notify you through the App or by other means. Continued use of the App after changes constitutes acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the App and delete your account.

18. Governing law and disputes

These Terms are governed by the laws of the Netherlands.

Any disputes arising from or in connection with these Terms or the App shall be submitted to the competent court in the Netherlands.

If you are a consumer residing in the EU, you may also make use of the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the intent of the original.

20. Entire agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the use of the App.
